Legal Question in Personal Injury in Canada
personal injury slip & fall
On Feb 7, 2008 at EdenH Real Arean, Punta Cana, DR I slipped & fell on the tile floor in our hotel room when I stepped in a puddle of water leaking from the fridge.
The fall happened about 12:00am and we were unable to get help to our room until I contacted our insurance co. the next morning. I went 10 hrs. with a fractured right knee, a torn right acl, loss of bowel control and multiple bruises, trauma and pain with no medical help available.
In the morning of the 8th I made contact with Assured Assistance Ins. and they got one of their spanish speaking employees to call the resort and send help to our room.
I was further traumitzed later that day when the manager ignored the hotel doctors orders and made me sit in a wheel chair (my legs were not braced) so that I could ride the elevator down to a side entrance rather than take me out safely on a stretcher through the main lobby. All the way to the ambulance he bereted me and pleaded with me to stop crying.
I have MRI's of both knees, all the documentation for my hospital visit in Punta Cana, Ortho Surgeon's diagnosis etc.
I want restitution for the injuries, the pain & suffering, loss of income and most of all for the loss of my health for years to come.

While we certainly sympathize with your situation and the serious injuries you have suffered, the circumstances of your accident combined with the ability to bring an action in the Dominican Republic make your case very difficult to take on.
Your first order of business will be to recover as much as possible from your insurance company. I presume that you are speaking of travel insurance when you mentioned Assured Assistance Ins.. What is their position? What are they willing to do for you?
In terms of a lawsuit against the resort very difficult. You already have the jurisdictional issue which at the outset would suggest that you would need a Dominican law firm to represent your case.
