Legal Question in Personal Injury in Canada
I recently went for a facial, to an independently owned and run salon, to help clear up my acne. After my sixth session I woke up the next morning with extremely swollen irritated eyes. I went to the clinic and was informed it was a 2nd degree chemical burn. I was prescribed antihistimines as well as advises to purchase vitamin E creams to help soothe my skin. After about a week my face looks alot better but I am concerned about any potential long term effects. The cost of each facial was $125.00 and my question is whether I am in the right to sue the salon. Due to the damage I was unable to attend work for the week. The facials included various face creams, masks, extractions, and a light machine (soli-tone 2500) which I believe most likely responsible for the damage.

You may well be able to successfully sue the salon, but the amount you may recover may not be enough to make it worthwhile. More facts are needed in order to determine whether or not it is worthwhile suing; quite likely an opinion from dermatologist is required, and an examination and report is not free. Please see a lawyer as soon as possible. Many lawyers will give you an initial consultation at no charge or obligation; the purpose is to see if you do have a case, if the lawyer & you are a "good fit" and whether or not the case is worth pursuing. Try and interview 3 or 4 lawyers. Be open with each of them and say that your are interviewing several; good lawyers don't mind that you do so in the least.
