The first step to take for a personal injury claim is to determine the limitation period. Except in special circumstances, one has 2 years from the date of the tort (event that gives rise to the action) to initiate the lawsuit. The first step is to determine the limitation period. If the period is about to expire, it is essential that either a Notice of Action or Statement of Claim is issued at the Court house and served personally on all parties.
