Legal Question in Product Liability in Canada

trademark/copyright/paten?

I have a business idea, it is on the net already , can you trademark/copyright and paten the concept if it has not been done yet. My marketing is different but the concept is the same. it would fall between a trademark and a paten.

Hi,

Although it is not possible to provide an answer concerning your idea without knowing it, it is probably not patentable because it is not new. A patent for a new use for a known invention is sometimes possible but always difficult.

On the other hand, protection with a trademark is possible.
