Legal Question in Real Estate Law in Canada

Appraisal

I was considering obtaining a mortgage and as part of the process an appraisal was required. I was instructed that I was to pay for the appraisal which I did so by post-dated cheque. As it turned out the mortgage process was terminated and the appraisal company will not release the appraisal to me because I was not the client, the mortgage company was. Do I still have to pay for it even though I cannot receive the appraisal? Would the appraisal company be able to come after me for payment if I stop payment on the cheque?

Re: Appraisal

If you pay for it, it is yours. If the appraisal company won't release the appraisal to you, then by all means, do not pay for it. If the appraisal company tried to sue you for payment, they would be denied because they refused to release the product.
