Can children of the common-law spouse be considered children of the marriage
How soon after cohabitation may children of the common law spouse be entitled to become beneficiaries in case of death of the non biological parent?

Never. it doesnt matter if there is a marriage or not. the only way they get anything if there is no will is to be adopted. there is no such thing as a common law spouse in CA.
