Legal Question in Wills and Trusts in Canada
An estate declares 6 beneficiaries but 1 of the beneficiaries dies. In the future will the estate then get distributed among the remaining 5 beneficiaries?

A properly drafted will takes care of this eventuality; if the will does not say what happens, then the will has to be examined by a lawyer in order to determine what is likely. In some cases the British Columbia Estate Administration Act has a scheme that will decide, and in other cases the wording of the will may be sufficient to decide. Without looking at the will it is not possible to say further.
