Legal Question in Wills and Trusts in Canada
how to find out if someone left a will
My mother passed away 4 years ago. I have a step father who after 1 week after my mothers death he stopped all contact with my brothers and I, I wanted to know how to find out if she had a will or not. I was not contacted by anyone and have been in the same place since then. I know she had money froman insurance claim she wanted to divide between her kids but we can't find my step father nor track down her lawyer for whom they made a will out too. I know there was a will as They had specified so. I just don't know how to take action in finding out where it is and whats on it.

Re: how to find out if someone left a will
Your first step would be to seach at the Court house in the jurisdiction in which your mother lived to see if an application for probate was filed. You will need to provide your mother's full name and her date of death and place of death. If a will was probated it will be part of the application. To find the lawyer or the custodian of the lawyers practice you should contact the relevant Law Society. They have this information. Otherwise if the lawyer was in practice with a firm or group contact them for information.
