Legal Question in Wills and Trusts in Canada
Where does the money go?
If money is left to a person that has died where does the money go? My husband great uncle died and there was money left to his father which passed away. What happens to the money that was left?

Re: Where does the money go?
It depends on the way the will was worded. If the will was per stirpes, it would mean that your father in law's gift may pass down to his children (your husband) equally. If the will said it was per capita, then the gift will go back to the estate of the great uncle and be distributed according to his will. You should contact the lawyer handling the estate to ask about how the failure of the gift to your father-in-law will be handled.
