Legal Question in Wills and Trusts in Canada
Notice of Intent to Apply for Probate
There is an estranged son and 3 grandchildren. The son had not seen his mother(the deceased) in 20 years. She had not seen two of the grandchildren in all that time and had never seen the 3rd.He verbally told us and her he did not want anything to do with her ever again and didn't.Do I have to notify them. The will stated she did not want anyone to know of her death and she only acknowledged the younger mentally disabled son and his 2 children.Thank you.

Re: Notice of Intent to Apply for Probate
If the deceased died in Alberta but did not leave any share to the estranged child you must show the relationship , name and address of the estranged child in the application but there is no obligation to notify the son of the mother's death. I cannot comment on the other jurisdictions.
