Legal Question in Real Estate Law in China
What is the process of changing my dead husband name on title on house in China?
1 Answer from Attorneys
The answer below is based on the assumption that neither you nor your husband is Chinese residents.
First, did he leave a will? If yes, are you (one of) the heir? If yes, please have the following documents notarized by a local notary office and authenticated by the Chinese embassy or the local Chinese consulate:(1) the power of attorney, it would involve complicate work, if you don't have a trust, it's very difficult to have the process completed. (2) the will, (3) the proof of death, (4) passport(s) of all the heirs, (5) proof that you are the identical heir(s) with whom stated in the will, (6) the property certificate.
In the case without a will, then above (2) is not needed, while others are.
I know this answer can only help a little, because as I said, it's not a simple but a complicated process. You need someone to act on behalf of you.
