Legal Question in Criminal Law in Colorado

Adult son aquitted of rape

My son now 30 four years ago was invited to (freind of family) dorm party. She asked him to stay over in dorm sleep on top bunk with two people (friends of hers) on bottom. They had consensual sex. He was aquitted, she had wanted to ruin his life due to family jelousy, long story. Any way he can't keep a job, they do a background check and fire him. Is there any way to remove that from his record? It seems it will follow him for the rest of his life. Ruining anything he gets going employment wise in his life! Ruining his life period!!!! Can he ever live a normal life he didn't do anything wrong, it's so sad.

Re: Adult son aquitted of rape

You son may be eligible to have the record sealed. It is not always applicable, but since he was acquited, it probably is an available option for him. This is a civil process that involves a number of steps that ultimately result in a hearing where the DA must prove that the need for public access to the record outweighs any reason he might have to have the record sealed. Also, keep in mind, it is sealed for public purposes only. Law enforcement (e.g. police, Courts, DAs) could potentially still access the information should it ever be necessary. My office can help in the process if you wish. Good luck.
