the court ordered supervised parenting time and random UAs, in 2008, my daughters bioligical dad followed the rules for awhile then stopped followed then stopped, he has not seen her for almost 4 months and refused to get a drug test or have supervised visits, he has stopped trying completly and my daughter and i have a great family life with a new man, can the biological dads rights be taken away in the state of colorado?

Based upon what you have said, not without his consent. If he is prepared to consent to the new man adopting your daughter, that can be done. However, abandonment would be the closest thing to use to terminate his rights based on your description. Abandonment generally requires at least 1 full year of absolutely no contact, and no support. In that situation, sometimes the best thing you can do is just leave the orders alone and let him go on ignoring you. It sounds like you have orders that protect your daughter from his drug problem quite well at present. It is unlikely, from what you have said, that you could get orders any more favorable.
