If I was a non driving passenger in a motor vehicle and I accidentally put the car in nuetral while attempting to flash the lights to gain the attention of the driver could that be considered a dui?

Control of the vehicle is a question of fact. In other words it depends on the specific facts of the case such as where you were sitting, was the vehicle running etc.
