Legal Question in Immigration Law in Colorado

Sponsor by my brother

I got an H1 that expired in 2005. Before expiration I applied for residence with an I-140 wich was denied after 2 years. So we a ppeal and my case was transferred to the ADMIN APPEALS OFFICE . I really don't know my actual status in USA. I moved to Colorado and now my brother just received the citizenship. Can he sponsor me, no matter my status, without having me to leave the country? If yes will I be able to get a work authorization? Thanks

The waiting period for Family Category Four (siblings) is more than 10 years at the moment. You will have to wait abroad until a visa number becomes available to you.
