Legal Question in Disability Law in Colorado

Threats to injure a handicaped individual and family

Does the ADA have provisions for preventing or punishing one who makes threats to harm/injure/kill a disabled individual and members of that individuals family? A Temporary Restraining Order has been obtained, however the answer to this question could aid in making that order permanent.

The ADA does not apply to this situation. Threatening someone, disabled or not, is a crime. Colorado's civil protective order (PO) law also applies. If you prove at the hearing that the defendant committed an act that is prohibited by the PO law and that unless prohibited by a permanent order will continue to commit such acts, the judge should make the PO permanent.
