Legal Question in Business Law in Colorado

Bond question for landscaping company

My landscaping company provided materials that have already been installed for a Sams Club that has opened. The General Contractor has not paid the landscaping company who will not pay me for my landscaping supplies (over $50,000) as they are having a a dispute. GC states they need a bond for over $400,000 and Landscaping company won't give bond due to some ''game''. What rights do I have as the GC told me they would cut me a joint check but are now holding the check for the bond which is out of my control. Please advise what options I have, if any?

Re: Bond question for landscaping company

Hello,

This is a tough one. Lien law for so-called "materialmen" is kind of tricky. You may have a lien right, but that will depend on much more facts and information.

Contact an attorney to review your contract and more facts to determine if you can file a lien and other strategies. You have a couple of options, but they can be somewhat complicated and should not be done without legal counsel, at least initially.
