Interstate Contracts
I edit a magazine and use freelance
writers all over the country. When
they sign a contract with me, which
state's contract laws apply, theirs or
mine--or both or either? (I'd like to
start using electronic contracts/
signatures, but the state laws are
confusing.) Thank you!

My suggestion is that your contract contains a choice of law provision together with a choice of venue provision. That way, you can, for the most part, decide which state will govern your contract and where you file suit.

First, I recommend that you may also consult with an internet attorney if you are planning on using electronci signatures.
The contract in question should dictate the controlling law. The question ultimately falls on where can a person expect to be sued or what law should apply in the event of a dispute.
