Legal Question in Business Law in Colorado
Non Profit Entity - 501c3 status - finally received. LLC was created in Colorado.
Since the non-profit hasn't actually begun business (was waiting for 501c3) can the non-profit (registered in Colorado) also set up a center in Arizona and New Mexico by registering the name but maintaining the same EIN for all 3 sites?
1 Answer from Attorneys
If the entity is in good standing in Colorado and you want to do business in other states with that entity, you will generally need to qualify the entity in those states. Qualification normally means filing certain paper work, paying their fees, and having a local agent for service of process.
I strongly recommend that you talk to an attorney to discuss the business issues, contracts, employment, and other issues before you get too far along. Good luck.
