Legal Question in Business Law in Colorado
I am an online magazine with paid subscribers. Is it legal for me to drive more subscription sales with monthly giveaways of donated product from my advertisers? Does this fall under sweepstakes/raffle laws and regulations? As a for-profit, would this be a legal incentive to drive sales?
1 Answer from Attorneys
Whether it is a legal depends on exactly how it is structured and presented. It sounds like a sweepstakes or contest and those must be structured to avoid characterization as a lottery under federal and state law.
Contact a business attorney to discuss the exact circumstances of your giveaways.
