signing confidentiality contracts & free speech

I signed a contract earlier that says, under no circumstances, am I permitted to give out any information about a company that I was going to be an Affiliate with. However, I feel that this company did me an injustice and their business practices are misleading to those becoming partners. Can I be sued if I share my experience and what I felt was misleading so that others do not fall into what I consider a deception. Does the private contract overrides our free speech? Thanks.

Confidentiality Agreements are common in business, lawsuit settlements, etc., and are generally perfectly valid. It really is not a "free speech" issue at all. If it did apply, this right, like many others, can be waived or bargained away. That is also a right people have. A lawyer may be able to review the documents and give you options, but hopefully this gives you some guidance. Also keep in mind that in a lawsuit, you may be painted as vindictive and trying to get them back. Perhaps best to consider moving on. Good luck.
