As a Franchise Attorney I can say this. Even in community property states (and Colorado is not a community property state) the other spouse is not considered an owner. In these states, the spouse usually has a community property interest in the entity. But this only becomes an issue for loans involving the community property assets, or in a divorce, where these assets are divided. Consult with a good business or franchise attorney in your area for specific advice.
