Legal Question in Business Law in Colorado

wrongful termination

I'm being terminated from my job for theft but have evidence that I could not have been the culprit. Do I have rights to unemployment? Can I file suit against my employer for announcing that I am a thief?

Re: wrongful termination

Hi,

Sorry about the termination. As a general rule, to get unemployment you must become unemployed through no fault of your own. A claim of theft is a basis to deny your unemployment. You can appeal such decision. See the website at http://www.coworkforce.com/uib/ for a discussion on unemployment issues and claims.

As for your other question on filing suit, a possible basis is defamation. They would have a defense if the information is true. Defamation is a complex and rather fact-specific area and there is no way to determine here what if any claim you could have.

You may want to contact an attorney if you are denied unemployment and suffer other consequences from this termination. Good luck.
