Legal Question in Civil Rights Law in Colorado

garage sale purchase

I purchased and item for $20.00 a garage sale. I paid in cash and told the lady I would pick it up later, possibly the next day. She said fine. I returned 5 hours later and she refused to give me the item. She said she had made a mistake, changed her mind and it was to cheap a price. She did except my offer and I paid for the item.

She tried to give back my money and I refused. I spent money to drive my truck to her home and back to mine.

Her Friend arrived and said everybody makes mistakes. She went into the house and when I knocked on the door her Daughter ordered me off the property.

She through the money outside and slamed the door. I did pick it up as the wind was blowing. I am not accepting it from her, but keeping it for her.

I think she sold it to someone else, for more mony, as she would not show it to me.

What are my rights?? Don't I own the item???

My opinion is that when you picked up the money you accepted the woman's rescission of her contract with you. Instead of the money, your ownership rights are gone with the wind.

Another lawyer may disagree. We always do.
