Use of Likeness
Is the use of a persons likeness against the law if used without malicious intenet nor financial gain? Specifically, is it against the law to post someones picture on my website?

If the photograph was taken in a public setting, meaning that the person could easily have been seen by others of the public at the time, no.

It's not a matter of being against the law, but of causing legal harm and having to pay compensation.
If the court orders you to take it down, then take it down. If they convince the court that you were being unreasonable, you might even have to pay for their attorney and court costs.
If you are using anyone other than a professional model, why would you do something against the person's wishes? Try to see it their way.
