I recieved a check at my old job that i had been waiting to come in. Instead of them calling me and telling me that the check had arrived, they called and told me the check was wrong and that they had to send it back so that I could get another one. Curious of how they would know that information i asked the employee that called me if she had opened my check and she told yes, because payroll told her to over the phone cause he wanted to make sure the check was right. It this illegal? And if it is what can I do to bring legal action toward the company?

It is probably no secret that payroll would know the amount of your check, or what it should be, from the perspective of the company. Another lawyer may disagree, but I see no reason why the company should be prevented from determining that it paid you correctly.

If it turns out when you finally get the check that they have mispaid you, then might be the better time to ponder legal action.

Meantime, raise a toast to your former paymaster this eve, wish him or her godspeed in paying you correctly, and rejoice that you will have that much less income to declare for 2007.
