Legal Question in Civil Rights Law in Colorado

Can I get Restitution

This is a two part question

Is there anything I can do legally if a person gave me a sexually transmitted disease and did not tell me? Also can I seek legal damages on the same person for not paying me half of hotel costs after the relationship was over. I asked and they said they will pay nothing. We agreed at the beginnings of the relationship to pay half and they never paid. Now that the relationship is over I asked for the money owed to me and was told I never asked you for anything. Of course this is not honorable and irrelevant to paying a debt. Is there anything I can do legally? Thank you.

Re: Can I get Restitution

There is a statute in the Colorado health codes that makes it a misdemeanor for someone who knows he or she is infected with a venereal disease, or even suspects it, to willfully expose another person to the disease. That could be the basis of a civil suit seeking money damages, if you can prove your partner knew before you had sex.

A suit to recover your hotel costs is less likely to succeed, unless you have more evidence than a personal oral agreement that no one else heard.

Chances are particularly dismal if either of you were married at the time. Although adultery is not a prosecutable crime, it is still listed in the criminal statutes, and an agreement involving an illegal act is not enforceable.

Good luck.
