No, downloading copyrighted material from a P2P network and burning a CD is copyright infringement. Of course, millions do it anyway without much risk of being caught. The P2P networks like KaZaA, Grokster, Morpheus, etc. are in more or less constant litigation battles with copyright owners. So far, the P2P networks continue unabated. If you are caught with illegal software or illegal songs on your computer you could face damages, but there are so many infringers that the copyright owners necessarily have to worry about stopping the biggest infringers and generally let the little guys like you go. So, as a copyright lawyer I warn you not to do it, knowing you probably will anyway and you probably will get away with it.
