Unjust enrichment
If my neighbor offers to landscape my yard and I say no because I dont have the money. can they landscape my yard and then sue me and succeed on unjust enrichment grounds?

No. There is nothing unjust about benefiting from work the neighbor performed despite knowing you were unwilling to pay for it. Whether you could persuade a judge or jury that this is what really happened is another story.

If it hasn't happened yet, put it in writing. Tell the neighbor that you unequivocably don't want him/her to touch your yard. If it has happened, word it differently -- i.e. that you never told them to do it, you couldn't pay for it, and you consider it a gift.
