Advance deposit for materials
I am a contractor who is doing some granite work for a commercial project. The granite company that I ordered the material from required a 50% material deposit. The other 50% upon material arrival in Denver. They have recieved over $25,000.00 since July 30, 2008. Now that all deposits have been paid and the installation is scheduled, the granite company does not have the money to obtain my granite. They have used my deposit money to cover other expenses. What should I do?

Good morning,
Sorry to hear about your issue. Given the amount at issue I would advise that you get counsel and threaten to file suit. This may get them to quickly come up with the money. They may be liable for civil theft and other remedies that open them up to liability for your attorney fees and, possibly, three times of the amount as damages.
