Legal Question in Construction Law in Colorado
Payment
I have a contract signed with a company (this contract is in my benefit) that is trying to get out of paying me. He has given me a check with a letter attached to it stating that if I cash this check that he has paid in full even though he still owes a balance. Can I cash this check and still inforce the invoice for the remaining balance?

I would be very careful here and contact an attorney to be sure. Depending on the language of the letter and statements on the check, this may be sufficient to be an accord and satisfaction. If that is the case, then if you cash the check you will have lost your right to pursue the balance.
