Legal Question in Construction Law in Colorado
Refund for construction down payment
We contracted with a pool company to build a pool. We gave them a 15% down payment of over $11,000. Five days later, we changed our mind and decided to move. No work ever started. The only cost they incurred was the pulling of county permits, which they did after we called them. The permits cost them $1700. Can we get the remainder of our down payment back?

Re: Refund for construction down payment
Hello,
You will need to carefully review the agreement. As a general rule, once the agreement is signed you are liable to the terms.
That, however, may not happen. If they are a busy company and have other contracts to take over for yours they may be amendable to an agreement where you pay the costs and some amount to terminate the agreement.
You should contact an attorney to review the agreement and consider the best strategies. Good luck.
