Legal Question in Construction Law in Colorado

Small Claims

We are a sub-contractor to a company who is in the process of being sued by the owners of the residence. We have nothing to do with their problems but we did a job for both parties, being given a verbal agreement by the owners and a written by the contractor. We would like to go to small claims court and collect from the owners but we are a corporation. My question is : Since we are a Corporation, Can we file a claim in the small claims court without a Lawyer?

Re: Small Claims

If you performed the work within the past 6 months,

You should serve a Mechanic's Lien on the owner and contractor.

Even if no lien is possible now, you should move to

be admitted to the existing lawsuit between owner and contractor.

If you file a small claims action as a corporation, you will most

likely be forced into County Court and that case should probably

get consolidated with the exisitng lawsuit.
