Legal Question in Construction Law in Colorado

Our townhomes have inadequate rain gutters which can't handle heavy rainstorms. In the winter ice accumulates in them and is beginning to build up under roofing material. Construction year was 2002; is it too late to require the builder to replace the gutters?
