Legal Question in Consumer Law in Colorado

Liability for accidental hotel property damage

I accidentally overflowed the bath tub at a hotel in Co. I cleaned up the bathroom, but didn't realize how wet the carpet was. The maintenance man came to the room as water had leaked to the meeting room below. He asked me if I was aware of a leak. I told him what happened. He said I may get a call from the manger later, there was some damage to computer equipment below. We moved to a different room. We never heard from the manager and there were no charges when we checked out. 2.5 weeks later I got a message to call the hotel GM. I return her call and she told me about the damage, that it was $4,300+ and they put it on my boyfriend's credit card but it was declined. I told her this was the first I had heard from anyone regarding any charges and that the incident was an accident. I also told her that I didn't have the money to pay. I asked about their insurance, she said they have a $5K deductible. She said she would contact the corp. risk mgr., maybe she could help me. In the meantime, my boyfriend tried to use his credit card and it was declined. Apparently, BofA approved a charge that put him $3,000 over his credit limit to pay the hotel. This was an honest accident, am I liable for all this?

I cannot give you precise advice about this situation nor do I do that through this service, I only give general legal information. In respect to improper charges on a credit card it is important to dispute them IN WRITING promptly with the credit card company, if you fail to do so it may have negative ramifications.
