Asking for a refund for cancelled travel package

We purchased a Mexico travel package for our relatives in Denver, Colorado State. Travel agent is in San Ramon, CA did not tell us that if we will cancel less than 30 days we will not get our money back, just get vouchers for travel within 1 year for the same amount we purchased original package. Travel agent never explained us the 30 day cancelation rules when we purchased vacation package with cancelation insurance.

We are trying to get our money back, not vouchers, so we could use it on something else.

What are our options? How could we take California company into court? We are Denver residents.

Also, do we have a case?

It would depend on the information that was sent to you in the beginning.

You say you purchased cancellation insurance. Did they send you a written insurance policy? Who is the insurance carrier ... usually travel agents use an outside carrier to sell travel insurance.

As far as taking them to court, you could probaby sue in Colorado (I don't know Colorado laws, but chances are they would enable you to take action there). However, enforcing the judgment could be a little harder.

In any case, it will depend partly on what your policy says.
