Medical bill collection - lawsuit

i just got lawsuit for my son medical bill that has been file for collection since Augest 2006. They add +10% interest & attorney fee. i contact them for months before they file the lawsuit. I wrote to them that I was agree to pay for it by monthly payment and the record will be remove from my credit report after it pay in full. The agency never response if they agree or not in writing. I did not want it to count. What can I do now to avoid the count lawsuit and do it in best way?? Please advice.

File an answer to the lawsuit within 30 days of its service, and then try to work something out with opposing counsel. Often lawyers can be more reasonable than bill collectors, because they have the ear of the client and don't make a commission on collections.

You might be able to file a chapter 13 bankruptcy which would 1. Stop all interest from accruing and 2. force the creditor into a 5 year payment plan.
