Wage Garnishment (national company in CO and VA)
Hi,
I am looking to garnish a subject's wages that has a Colorado issued judgment, but the subject physically lives in Virginia. Further, they work for Northrop Grumman which has physical locations in both Colorado and Virginia. I assume that I can serve�the garnishee�Northrop Grumman in Colorado and this will garnishee the subject's wages regardless of their physical location. Is this sadly misplaced assumption or will this do the job?
I am already looking to perform a similar procedure but through bank account garnishment through the subject's bank tha that has a branch in Colorado. Thank oyu for your time!

That sounds like it would make a good law school examination question. First of all, I think that the judgment should be recorded and made executory in the county and state were the judgment debtor resides. And I am pretty sure that you may conduct garnishment wherever the judgment debtor has assets, one of which would be his wages due him, wherever they may be located. I am not so sure that you could enforce a garnishment out of a court in Colorado if the judgment debtor's wages were being earned, held and paid in Virginia. Perhaps by so serving the employer with a garnishment in Colorado, if it is in fact the same corporation/employer that the judgment debtor is working for in Virginia, you could enforce a garnishment instituted in Colorado to recover wages earned, held and paid in Virginia. If you are in Colorado, that would at least be worth a try, as it would not be so complicated and expensive as attempting to have the judgment made executory in Virginia and then issuing the garnishment out of a Virginia court. You might just call Northrop Grumman's pay-roll department and/or or legal office in Colorado and/or Virginia and ask them how they would deal with such a garnishment issued out of Colorado to garnish (seize) wages earned with their company at one of its Virginia facilities. Of course, I am no expert on interstate collections, so there are other lawyers who could give you a more definitive answer; but for the time's being, this is the best you have from this one Louisiana lawyer.
