Can a spouse legally obtain (copy) information from their spouse's hard drive that is located in their home (home office of spouse) wihtout the spouses knowledge?

If you live in the same home, yes. If you have information on your hard drive that you want to keep confidential, password-protect it, encrypt it, or both.
