Age of Consent and Statutory Rape

One of my friends is 19 years old. He is dating a 16 year old girl. We are always arguing whether he is comitting statutory rape by sleeping with her.

In Colorado the age of consent is 15 years and four years older. Meaning that to constitute statutory rape, the minor has to be under fifteen and the accuser more than four years older. There is a misdemeanor for being over 15 years old but under the age of 17 and the accused is 10 years older.

All of what Mr. Huttner says is true. In addition, if the older person is "in a position of trust" and the younger is 17 yo or under, then it is statutory rape. A position of trust is someone that acts like a guardian on a part time basis, like a teacher, baby sitter, priest, coach etc.
