In the State of Colorado, what guidelines do law enforcement and the USDA have to follow before seizing horses?

The State of Colorado can seize any horse for which there is probable cause to believe the animal has been mistreated, neglected, or abandoned, so that its health or life is endangered. The USDA likely follows similar guidelines.
A hearing before a court is then set, and the owner given notice at least five days before. The hearing is to determine whether the owner is fit to own the horse.
Although almost everybody is fit to own a can of peas, not everyone is fit to own a living being.
