Assault and Battery

My stepson (12) and his friend (13)who is staying with us got into a fight with another student (11) on their way home from school. His friend started the physical contact after a statement was made about his mother. He ''talked'' my stepson into taking a couple of kicks also once the other boy was on on the ground. I received a call from his school today informing me about his suspension and assault and battery charges. While I am agreeing with the charge, I would like to know what I can expect. We are located in Aurora Colorado.

Although the kicking while the student was down is particularly egregious, you may be able to get a diversion for your stepson, assuming the victim agrees and your stepson has no prior record. A diversion would keep him from a criminal record and likely include classes and, if there were medical bills, restitution.
