Legal Question in Criminal Law in Colorado
assault charge
I was on vacation in Colorado and got in a fight. I was arrested and given a 3rd degree assault charge in Summit County, CO. Is it probable that i will see jail time for this? How can I avoid having to go from Wisconsin to Colorado for court?

A 3rd degree assault charge can result in jail, but rarely does. If you have a lengthy criminal history, you might face jail, but it is more likely that you will not be SENTENCED to jail. That said, you can still be arrested if you miss court dates and/or do some other dumb stuff. You will need to either: (a) return to Colorado; (b) hire someone to appear on your behalf (an attorney). If you don't have any criminal history, it is very unlikely you will do any jail time. However, you must return to CO to handle this case and if you don't an arrest warrant will go out and could mess you up if contacted by the police in WI. The only way to possibly resolve this without returning to CO is to hire an attorney to see if the case can be dismissed or plead down to something that can be handled by mail.
