Legal Question in Criminal Law in Colorado

Assault charges against me while at hospital intoxicated.

After celebrating with my friend of her upcoming nuptials, my husband took me to the hospital after I didn't respond to his trying to ''wake me up'' on the way home. While at the hospital, I unknowingly kicked a staff person. I don't recall any of my actions. I was charged with assault. I have a squeaky clean record, never had any police contact/previous charges due to alcohol or assaulting anyone. I am humiliated more than I can describe, and very nervous when I have to face a judge the end of December. What should I do?

At your first court appearance, bring whatever medical evidence and witnesses you have which suggest you were not conscious or in control of your actions at the time you lashed out with your foot. It is possible the district attorney will dismiss the charge outright. If the DA does not, plead not guilty and consult with a lawyer.

Good luck.

Depending on the nature of the assault charge, the jurisdiction and the Judge this could be a very serious charge. I would have an attorney review the matter. I have done many similar facts situations and usually they resolve with limited consequences.
