Well, first you've got to be captured; that's essential. Once you're in custody or confined, then you've got to try to get away. But the beautiful thing about that is, if you're sleepwalking when you try to get away, or under hypnosis, or in a fugue state, that's not attempted escape, because you have to know that you're trying to get away. That would also disqualify a really dumb guy who just thinks he's going for a little walk when he's apprehended.

The same thing applies when you're on a work crew.
