Legal Question in Criminal Law in Colorado
my boyfriend was on ISP and then sentenced to comm corr. he was recently revoked from comm corr for missing an alcohol class and is in jail now.he has a year left of his sentence. we want to know if it would be beneficial to have a lawyer represent him in court and if he could get back on ISP? or would requesting drug court be a good choice? also, if sent to DOC how long would he most likely stay there with only one year remaining of his sentence?
1 Answer from Attorneys
There are many variables to the question.
From your question it appears that the Judge could impose the remaining year in a form of incarceration. This could be served in county jail, DOC, or com cor. However, in most cases the Judge does have discretion for alternative sentencing. The Judges decision will be based on such factors as the probation officer report, prior criminal record, number and types of violations, original charges, victim input, etc.
Although no attorney can guarantee results, in my opinion a person that is represented by an attorney usually has fewer consequences than somebody that goes it alone.
