Legal Question in Criminal Law in Colorado
My boyfriend has a trial date coming up on a dv case that I did not press the charges on him the state did. I have not yet been served a subpoena but his lawyer said the prosecution will attemt to try really hard to. I am not a US citizen I am German on a student visa. I have a trip palnned to go back to Germany that was pammed months ago before the trial was set. I will be out of the country on the date of the trial. What am I suppose to do, Ive begged the da to drop the case becasue he is a veteran and has TBI which causes dissasoxiated states which is what caused this, all he did was push me and throw a piece of makeup at me durinf an argument and a Dr even wrote a letter stating he was not responsible for hos actions on that day. Since I will be out of the country on the date of the trial and they are able to subpoena to me what are my options annd possible consequences. Thank you

If you are not served with a subpena then you don't have to go to the trial. If, however, you are served and you do not appear, a warrant may be issued for your arrest. If you are served you could explain your conflict to the prosecutor and see if they can postpone the trial, but they will likely need the agreement of your boyfriend's lawyer to do that.
