what could you do about changing a assualt menacing charge to what it was suppose to be which is a menacing charge?

The prosecution selects which charge it wants to prove. A defendant cannot change the charge alone. The jury will decide whether the evidence is sufficient to prove that charge. A counseled and prepared defendant can convince the prosecution that it cannot prove a certain charge. That happens in trial preparation and plea negotiation. Get counsel.
