Legal Question in Criminal Law in Colorado
Charged with adult penal. My husband pulled over into a parking lot to take a phone call from a client and book an appointment for our jointly owned massage business of 17 years. He had 2 phones 1 that is business phone talking to the client and the other was his personal phone he was using to schedule the client through the schedule app. When he finished he proceeded to drive home and noticed as he backed up a woman was standing in the rear of the vehicle appearing to take a photo. He thought nothing of it and on the street we live on pulled over to help a man jump his car. While he was helping this gentleman a police officer pulled over and stared to write the charge for a ticket of Adult Penal stating a woman saw him masterbating in his car. The only evidence is this woman's statement and a picture of the license. I think he should state not guilty, period. No evidence. What's the worst case scenario if they find him guilty. Jail time? Etc. I want him to request a trial by jury

You need to understand that your husband asking for a jury trial is not going to help him much. This is because your husband - even if he happens to be an experienced trial attorney - is not cut out to handle a criminal trial where he is the defendant. He needs to retain a lawyer and his lawyer needs to request a jury trial. If the facts and evidence are what you believe them to be, it sounds like a very defensible charge.
The worst part of what your husband is facing is the possibility of having to register as a sex offender if he is convicted. He needs a lawyer and he needs to discuss the case with a lawyer and no one else.
