Can He Be Charged?

My boyfriend and I had a domestic dispute 2 years ago and in the process he damaged my car. I did report it to the police and they still have a felony criminal mischief warrant out for him. He did pay for all of the damages and I've told the court that I refuse to testify since he paid for the damages. Can they still arrest him for this?, isn't there some type of statute of limitations to charge him for this incident?

If I understand you correctly, that there is an existing felony warrant for his arrest, that means he has already been charged. There is no statute of limitations for somebody trying to avoid arrest. If he's stopped for a traffic ticket, or anything else, he will be arrested.

Your refusal to testify will seriously weaken the case against him, but not necessarily kill it, especially if there are other witnesses or statements in evidence.
